Responsibilities of Lapindo Brantas

TEMPO Interactive, Jakarta:The government’s attitude toward the conclusion of the National Commission on Human Rights (Komnas HAM) on the Lapindo mudflow disaster is shocking. There was no significant response from the ministers, let alone President Susilo Bambang Yudhoyono. Komnas HAM categorically states that the mudflow in Sidoarjo was not a natural disaster - it was a crime and it destroyed the environment. Lapindo Brantas, the drilling company responsible for the mud volcano, should be tried. Compensation must be borne by the Bakrie family which owns this company; it should not be borne partially by the state as is the case now.

Komnas HAM also concludes that the environmental damage caused by the blast is so horrific that it should be declared an ecocide, or a crime against the environment. The mudflow that started in 2006 has submerged 12 villages and claimed 12 lives. The economic and social potential of the region has practically been destroyed. A total of 60,000 people have been displaced. The mud also pollutes because it releases the toxic hydrogen sulfide. As a result, 81 percent of the people suffer from respiratory problems. Water sources are polluted, so it cannot be used.

Given the staggering scale of the damage caused, Komnas HAM is of the opinion that the tragedy should be considered as a gross violation of human rights. However, since Law No. 26 of 2000 on the Human Rights Court does not include any clause stipulating environmental destruction as a violation of human rights, this tragedy is considered an ordinary violation of rights. The Lapindo mudflow case should be a cause to revise this law.

Komnas HAM’s findings are not really surprising. Several independent investigation teams came to a similar conclusion, even the East Java Police. Unfortunately, their investigation was terminated when a Letter to Inquiry Termination (SP3) was issued on the grounds that the evidence and witnesses presented by the police were inadequate. No trial was ever held on the case.

Such reasons should no longer be relevant. There was ample evidence that the Lapindo mud volcano was caused due to human error. The findings by Komnas HAM could be the basis to reopen investigations. All it takes is an order from President Yudhoyono to the Chief of Police to follow up on the Commission's findings.

Both the government and the House of Representatives should correct their erroneous attitude towards the tragedy. They considered it a natural disaster. Based on that, the state had to partially bear the costs of handling the sludge. Not only was it subsequently regulated by a presidential decree, funding would also later be provided for in a Law on the State Budget.

Their indifference towards the findings by Komnas HAL is only delaying the resolution of the problem. This crime against the environment and this human tragedy will certainly continue to be raised and questioned for as long as justice has not been done.

Ja-ja en nee-nee h`e bro.K'nijn, ik weet nu ook wie bung Boudewijn is, maar bekend bepaald niet, er waren veel van die troubadours in de vijftig en zestiger jaren die op een jammer-hout onder de arm weg strumde en een "message" brachten aan ieder die wilde luisteren " make love, not war" of "flower-power" en dergelijke. Ik was in die tijd en ben nog steeds meer geinteresseerd in lagu-lagu keroncong en hawaiian muziek, dat is in 't bloed, zo je moet me maar vergeven voor mijn onvergetelijkheid ik zou mischien beter onder 't schuilnaampje of si Bodoh gaan sampai strakkies!!

In die jaren was ik een puber en ging weleens in de zomers naar het strand tussen Zandvoort en Bloemendaal.
Boudewijn de Groot en Lennaert Nijgh (zijn latere tekstschrijver) waren daar dan ook met een groep puber jongens en meisjes, in de zomer sliep de hele groep op het strand, vrijend, gitaar spelend, vuurtje stoken van aangespoeld hout, kletsend, alcohol drinkend, etc.
Boudewijn is in hetzelfde jaar geboren en ook in Batavia (in het Jappenkamp Tjideng).

Ik was soms op het strand met mijn eigen (puber) vrienden vlak naast de groep van Boudewijn.
Alleen onze groep hoorde bij de gewone jongens en meisjes, niet niet op het strand gingen vrijen en slapen en geen alcohol, we hadden alleen flesjes water en limonade.
Maar we luisterden wel naar de liedjes.
Boudewijn en zijn kornuiten waren scholieren die op een "kouwe kak" (deftige) school in Bloemendaal en Heemstede (ook een deftige school) zaten. (dit staat overigens niet goed vermeld op Google !!!
Boudewijn was toen nog niet bekend geworden en zong nog geen protest liederen. Dat kwam pas toen hij 20 jaar oud was.
(meisje van 16 en meneer de president etc.).

Mijn groep zat op gewone scholen in Haarlem met gewone mensen, niks deftig!
Simpele, eenvoudige zielen, zogezegd, met Hollandse en Indische afkomst.
Dan ga je niet op het strand vrijen en helemaal niet de nacht doorbrengen op het strand, maar netjes op tijd naar huis, zoals het hoort en zoals het moet van je ouders.
